Man indicted for being at Elkton school

BROOKINGS — A Brookings man has been indicted by a grand jury for loitering at the Elkton School while a registered sex offender.

According to the indictment, Andrew Polly loitered in the Elkton school, a designated community safe zone, on or about Feb. 9.

Polly, 27, is listed on the South Dakota sex offender registry as restricted from community safe zones. He was convicted of felony sexual contact with a minor under 16 in Union County in 2017.

According to sources familiar with the investigation, a complaint about Polly being at the school in Elkton was filed with the Brookings County Sheriff’s Office and turned over to the state’s attorney’s office, which presented the case to a grand jury on April 9. 

Loitering in a community safe zone while a registered sex offender is a class 6 felony in South Dakota — the lowest level of felony charge. It is punishable by up to two years in prison, a $4,000 fine, or both.

The indictment requests a warrant be issued for Polly’s arrest.

Polly was booked into the Brookings County Detention center at some point after the warrant was issued, but was no longer listed on the jail roster on Monday morning.
