BROOKINGS A contractor from the Brookings area will serve time behind bars and pay restitution after pleading guilty to misappropriating more than $37,000 that was owed to his subcontractors.
Kody Harming was convicted of felony grand theft by misappropriation, according to information from the Brookings County States Attorneys Office. The terms of the sentence handed down by Judge David Wheeler on Sept. 9 were:
- Repay the entirety of the restitution to the subcontractors.
- Serve 45 days in jail.
- Placed on four years of probation.
- Other terms and conditions also apply.
If Harming fails to meet any of the probation requirements, he could face up to five years in the South Dakota State Penitentiary in Sioux Falls.
The case stems from a commercial building project last year in Brookings. The resulting investigation, which began this year, found that bank records showed how the $37,000 was used for personal purchases.
We want to ensure that entire restitution amount is paid during his probationary period, Brookings County States Attorney Dan Nelson told the Brookings Register. Mr. Harming took advantage of and abused the trust those subcontractors had with him but now faces the consequences of his actions.
