A Sioux Falls man who previously lived in Brookings is facing a one-count indictment for first-degree rape.

Jason Menzel, 33, is accused of raping a 5-year-old girl at a home-based Brookings day care more than two years ago.

He pleaded not guilty to the Class C felony in Brookings County Circuit Court on Tuesday. If convicted, he faces up to life in prison and a $50,000 fine.

Court documents accuse Menzel of accomplishing an act of sexual penetration with a 5-year-old girl between July 1 and Aug. 24, 2007.

He was indicted by a Brookings County grand jury on Oct. 30.

A report from the Brookings Police Department says that on Sept. 1, the father of the alleged victim told authorities that his daughter had been sexually assaulted two years ago while attending day care.

The report claims that Menzel confessed to sexually assaulting the girl in July 2007 and that the action took place on at least 10 separate occasions . The alleged assault occurred at a home day care in the 1900 block of Council Ridge Road, court documents say. Menzel is currently free after his parents posted a $100,000 cash bond.
